Terms and Conditions

1. Scope and Applicability

These Terms and Conditions govern the luxury property selection relationship between ProPrimeAptX and our clients. They form an integral part of all contracts regarding our luxury apartment selection and premium property services, consultation offerings, and certification services. By enrolling in or using our services, the client fully accepts these Terms and Conditions and commits to honoring the luxury property selection standards they represent.

2. Contract Formation and Scope of Services

A luxury property selection contract with ProPrimeAptX is formed either through mutual signing of a written agreement or through our written confirmation of a client's enrollment. The exact scope of services, luxury selection objectives, timeframe, and investment are defined in individual contracts or enrollment confirmations. Changes or additions require written form and mutual agreement.

3. Service Offerings

Our luxury property selection service offerings include but are not limited to:

  • Luxury apartment selection and premium property services
  • Market analysis consultation and guidance
  • Certification and luxury property knowledge-building services
  • Luxury planning and property workshops
  • Market analysis competency sessions
  • Corporate luxury development services
  • Personal luxury property consultation and strategy planning sessions

4. Investment and Payment Terms

Our luxury property selection investment fees are stated in Swiss Francs (CHF) and are subject to applicable taxes. For extended services, we reserve the right to issue monthly payment plans. Unless otherwise agreed, the following payment terms apply:

  • Single services and workshops: Payable within 7 days after enrollment and before service start
  • Services with a total duration of up to 3 months: 50% upon enrollment, 50% at midpoint
  • Long-term luxury property selection services: Monthly billing with a payment term of 15 days
  • Intensive consultations and certification services: 100% advance payment no later than 21 days before the event

5. Refund Policy

ProPrimeAptX is committed to honoring the professional nature of our luxury property selection work. Our refund policy reflects our understanding that luxury property selection is a significant investment in one's residential future:

  • Service Cancellation by ProPrimeAptX: If we cancel a service or consultation for any reason, clients will receive a full refund of all fees paid.
  • Withdrawal Prior to Start Date:
    • More than 21 days before start date: Full refund minus a CHF 150 administrative fee
    • 14-21 days before start date: 75% refund
    • 7-14 days before start date: 50% refund
    • Less than 7 days before start date: 25% refund
  • Withdrawal After Service Start:
    • Within first 20% of scheduled service duration: 25% refund
    • After 20% of scheduled service duration: No refund
  • Exceptional Circumstances: In cases of serious illness, family emergencies, or other life-altering circumstances preventing participation, we will consider compassionate refunds or service transfers on a case-by-case basis with appropriate documentation.

All refund requests must be submitted in writing to info@proprimeaptx.com. Refunds will be processed within 10 business days and issued using the original payment method. We honor the trust placed in us and handle all refund requests with care and professionalism.

6. Session Scheduling and Cancellation Conditions

Agreed luxury property selection sessions are professional appointments. For cancellations or rescheduling by the client, the following guidelines apply:

  • Cancellation up to 48 hours before the session: free rescheduling
  • Cancellation 24-48 hours before the session: 50% of the session fee
  • Cancellation less than 24 hours before the session: 75% of the session fee
  • No-show without notification: 100% of the session fee

In exceptional circumstances (such as serious illness with documentation), we strive for accommodating solutions. ProPrimeAptX reserves the right to reschedule sessions for important reasons. In this case, the client will not incur any costs.

7. Client Commitment and Responsibilities

The success of our luxury property selection work depends significantly on the client's commitment and engagement. The client therefore commits to:

  • Provide all information necessary for luxury guidance completely and truthfully
  • Complete agreed assignments and luxury practices with dedication
  • For corporate services: ensure affected team members have the necessary time and resources for luxury property selection
  • Provide feedback to enable continuous enhancement of our luxury offerings
  • Maintain confidentiality regarding other clients' personal luxury sharing

8. Confidentiality and Luxury Trust

ProPrimeAptX is committed to the highest level of confidentiality regarding all client information and luxury property selection details. This luxury trust applies beyond the termination of our relationship. We treat all client and session information with the deepest respect and do not share it with third parties without express consent. The collection and processing of personal data takes place in accordance with our Privacy Policy and applicable data protection regulations.

9. Intellectual Property and Usage Rights

All luxury property selection materials, concepts, methodologies, and other service products created by ProPrimeAptX are protected by copyright and held as luxury property selection intellectual property. The client receives a non-exclusive, non-transferable right to use them for personal luxury property selection. Sharing with others or commercial use beyond the agreed scope is not permitted without our express written consent. ProPrimeAptX reserves the right to use developed methods and concepts in anonymized form for other clients as well.

10. Testimonials and Luxury Sharing

ProPrimeAptX is honored to share client testimonials and luxury success stories unless the client expressly requests privacy. The use of photos or detailed personal luxury stories for marketing purposes, however, always requires the express consent of the client. At the client's request, specific confidentiality agreements can be made to regulate this point in more detail.

11. Liability and Luxury Property Selection Disclaimer

ProPrimeAptX provides luxury guidance and selection services with the utmost care and to the best of our knowledge and luxury property selection expertise. However, we do not guarantee the achievement of specific luxury outcomes, as luxury property selection is a deeply personal journey. Our liability is limited to intent and gross negligence and is limited in amount to the agreed fee. Liability for slight negligence, indirect outcomes, or personal luxury journey variations is excluded.

12. Term and Luxury Property Selection Completion

For ongoing luxury property selection relationships, the term and notice period are based on the individual luxury property selection agreements. Unless otherwise agreed, a notice period of 30 days with respect and professionalism applies. Both parties reserve the right to complete the relationship for important luxury property selection reasons. Completion requires written form and mutual respect.

13. Final Provisions

Should individual provisions of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. An effective provision that comes closest to the luxury property selection purpose of the invalid provision shall replace the invalid provision. Changes or additions to these Terms and Conditions must be in writing. Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zürich, insofar as legally permissible.
